Notice of Privacy

Wide Area Rapid Notification, a service provided by W.A.R.N., LLC, (hereinafter "W.A.R.N.") believes you care how information about you is used and shared, and that you trust we will do so carefully and sensibly. This notice contains details of our privacy policy. By either visiting or subscribing to "W.A.R.N." data services or professional services or software or applications, you are accepting the practices described in this Privacy Notice.

WARN Use Terms and Conditions

WARN notification service is to be used for the intended purpose of communicating informational messages to WARN Clients’ members or contacts and will not be used for solicitation and/or telemarketing. WARN Clients have the right to or obtain permission from every member or contact to use the landline, email or cell phone number used to communicate these notification messages. Use to contact cellular numbers without the right or prior permission, or for telemarketing or solicitation purposes will, at WARN’s sole discretion, result in termination of account and no fees will be refunded. Additionally, client using the service in such manner shall be liable for Federal FCC and FTC damages, fines and legal costs, plus and any applicable state penalties, fines and legal costs. 

Further, WARN Clients understand that they have the responsibility to provide the device addresses to WARN in order for WARN to send Client messages to Client’s recipients. It is also the responsibility of WARN Clients to provide opt out processes to their recipients.

WARN Clients acknowledge and understand that WARN acts as a conduit for the provision of information and content. WARN Clients acknowledge that WARN shall not be responsible or liable for any content transmitted and that full responsibility for content shall rest on the WARN Client. WARN Client shall observe all relevant laws and regulations applicable in their jurisdiction and in the jurisdiction of all persons to whom they cause messages to be delivered. It shall be the sole responsibility of WARN Clients to familiarize themselves with all applicable laws, regulations and codes of conduct to which they may be subject and to ensure compliance therewith.

WARN Clients shall furthermore ensure that all messages, information and content produced or generated by a WARN Client for transmission or delivery by means of the Services shall comply with all laws and any relevant code of conduct to which WARN itself subscribes and is bound in all territories where messages are sent by, or received from, the WARN Client.

WARN notification services send some of the notifications, on behalf of WARN Clients, via SMS messages that contain alerts and alert information. Recipients that subscribe to these notifications or receive these notifications as part of their job may receive messages based on response management alerts sent by WARN. Message frequency can be up to 30 messages per month. Message and data rates may apply. Information on this service can be obtained at any time by texting HELP to 57239 or calling 1-888-309-4646. To cancel the service, text STOP to 57239 at any time.

In the event that a recipient has applied to WARN Client to opt out and has not been blocked from receiving notifications by WARN Client and therefore wishes to lodge a complaint that a WARN Client has used the Services in any manner that infringes on the complainant’s rights or the rights of another person, the complainant shall provide WARN with a written notice setting out:

  1. the name of WARN Client that is sending offending notifications;
  2. the full names and address of the complainant;
  3. the written or electronic signature of the complainant;
  4. identification of the right that has allegedly been infringed or the law or code of conduct alleged to have been infringed;
  5. identification of the material or activity that is claimed to be the subject of unlawful activity;
  6. the remedial action required to be taken by the service provider in respect of the complaint;
  7. telephonic and electronic contact details, if any, of the complainant;
  8. a statement that the complainant is acting in good faith; and
  9. a statement by the complainant that the information in the complaint is to his or her knowledge true and correct and an indemnity by the complainant in favor of WARN for any misrepresentation of the facts or for wrongful suspension or termination of any Services by WARN in response to the complaint.

WARN will not intercept, monitor, copy or disclose any Client or recipient messages or personal information about the Client or recipient other than in the normal course of the use of the Services, without the Client's prior permission unless WARN believes in good faith that such action is necessary to conform to legal requirements, to co-operate or comply with legal process, investigations, summonses, subpoenas and the like, to protect and defend the rights, property or legally protectable interest of WARN, the Client or other third party, to enforce any of the provisions of these terms and conditions or to protect WARN's business or reputation. The Client agrees that WARN may access its account and message contents for the purposes described above without notice and in order to respond to service or technical issues and that WARN may communicate with the Client from time to time for purposes including, but not limited to, communicating information regarding any updates, upgrades, notices, or other information.

Notice to recipient of WARN Notifications

The content of messages and the distribution list for messages, including device addresses, are the responsibility of Clients of WARN and are provided to WARN by Clients for the purpose of distribution of notifications for Clients of WARN. If recipients wish to opt out of receipt of these notifications they should contact the Client sending the notifications or by following the procedures above. Should the recipient not be able to contact Client then they should send an email to support@warncalling.com with the address of the device receiving the notifications, the name of WARN’s client sending the notification and the name of the recipient receiving the notifications or by following the procedures above.

Personal Information

Information from you helps us continually improve your use of "W.A.R.N.".

There are four types of information we manage:

Information From You: We receive and store any information you enter on our Web site or give to us in any other way. We use the information that you provide for such purposes as responding to your requests, making available future services or products for you, improving the quality of our services and offerings, and communicating with you.

Automatic Information: We receive and store certain types of information when you interact with us. As with numerous Web sites, we use"cookies," primarily for information provided automatically when your Web browser accesses "W.A.R.N.". Many firms offer utilities which are designed to help you visit Web sites "anonymously."

E-mail and Telephone Communications: To improve your e-mails usefulness and value, we receive a confirmation when you open e-mail from "W.A.R.N." if your computer supports such capabilities. In this way we seek to confirm that all emailed alerts, notices or alarms are received as intended. If you are a paid subscriber, we respect your privacy and will only initiate calls to your provided telephone numbers in the event of an alarm in the region, zip or area code provided with each of the respective telephone numbers. Your telephone number is never sold or provided for marketing purpose.

Information on other issues or services: To provide better products or services that you may wish to consider, we may relay information (separately from our official communication) to you. You may at any time request that we discontinue any non-essential or secondary information, not related to the delivery of the core alert and alarm services.
